Construction and engineering disputes

The Construction and Engineering team has an excellent track record in dealing with and resolving construction, engineering and process plant disputes, including the use of court proceedings and alternative dispute resolution processes such as negotiations, adjudication, arbitration and mediation.

We also provide advice on the incorporation of appropriate dispute resolution processes in contracts. During the course of the project, we can assist with measures that can be taken to avoid or at least minimise disputes arising, and to enable you to work towards achieving a successful delivery of the project.

Above all, we do our best to resolve disputes as quickly and as cost-effectively as possible.

We’re known for our strong presence in the region. We act for public authorities, developers, funders, consultants, contractors, specialist sub-contractors and home-owners. They appreciate our straight-talking, commercial approach.

We advise on:

  • Claims for payment
  • Claims associated with defective and incomplete works
  • Claims arising out of variations to works
  • Prolongation claims
  • Loss and expense claims
  • Contract termination
  • Disputes arising under all of the standard forms of contract as well as bespoke forms, including those used in public procurement, notably PFI and PPP

Some examples of our work:

  • An ODA (Olympic Delivery Authority) project in London
  • A specialist contractor’s works on a UK military base
  • Security installation works on projects in Austria and Germany
  • The renovation of an 18th century crescent of town houses in the West Country
  • The refurbishment of a hotel in the Cotswolds

Our COSTControl system allows us to take a practical approach to dispute resolution funding. It creates an overall risk profile at the outset, and provides an early focus on settlement strategy. It provides flexible fee structures including conditional fee agreements where appropriate.

What others say about us

The Construction and Engineering team will “always communicate, and will mention if they don't need to get involved in order to minimise cost”.
