Our Team has extensive experience in defending claims acting for self insured entities, businesses with large insurance excesses or deductibles, acting for Insurance Companies off panel, and for uninsured businesses and individuals.  We also act in tracing Insurers and in relation to contribution claims.  The Team is recognised by the Legal 500 as a third tier firm.

Claims Defence

The Team specialises in defending businesses and individuals against claims brought by employees, or the public for compensation for personal injury and/or property damage in the following contexts:

• Employers Liability

  Where your employee is injured at or during the course of work.  We are experienced in defending claims brought pursuant to the “six-pack” Regulations or in negligence.
   

• Occupational Disease Claims

  Where an employee or former employee has brought claims including noise induced hearing loss, mesothelioma, asthma, and other occupational diseases.
   

• Public Liability

  Typically where a member of the public is injured on your premises or land or as a result of the course of your business activities, including Occupiers Liability Act claims and claims against residential landlords.
   

• Product Liability

  Where a consumer is injured or property is damaged through the use of the product typically on the basis that it is alleged that the product is not manufactured correctly or that its instructions are not adequate. 
   

• Employee road traffic accident liability

  Where your employee is injured in a company vehicle during the course of his/her employment or where your employee injures someone else during work time, we can work with you to thoroughly investigate the accident, and to work with your fleet road traffic insurer to defend the matter to ensure that your name is protected and that insurance premiums are not increased unnecessarily, and to actively seek to ensure that.
   

• Legal costs/detailed assessments

  The Team works closely with Thrings’ dedicated costs team, Paragon Costs, to offer an all round service in relation to quantification of adverse costs orders, and can assist with detailed assessment hearings and costs appeals.
   

• Risk Management

  The Team also provides pre-emptive advice to seek to avoid the instances of claims. We can provide advice on Health and Safety regulation, compliance, risk assessment issues, and Health and Safety offences such as corporate manslaughter.
   

• Fatal Claims

  We are experienced in acting for employers, and representing businesses in fatal accident claims brought against them, including representation at Inquests and in Health and Safety prosecutions, as well as acting within civil proceedings.
