Harvey is a solicitor in the Planning and Environment team. He joined Thrings in February 2022 and is a member of the NFU and CLA.

In addition to his role at Thrings, Harvey also owns and manages a farm enterprise in Herefordshire. He is passionate about small business and its positive economic, environmental and social impact. He possesses a unique blend of legal and business experience in the rural sector which underpins a deep understanding of a client’s business and their requirements. His practice straddles the firm’s Agriculture and Development of Land teams and he has developed particular expertise in the environmental challenges affecting these sectors, especially in relation to the Habitats Regulations and the issue of nutrient neutrality.

Development of Land

Harvey’s work with the Development of Land team is predominantly residential development whether advising on applications for planning permission or the use of permitted development rights such as Class Q or Class MA. He is able to deliver specialist advice relating to issues relating to the application of Habitats Regulations to residential development. He regularly negotiates s106 agreements, deeds of variation and unilateral undertakings, as well as advising on other development matters such as overage, easements and restrictive covenants.

Agriculture

Alongside the Agriculture team, Harvey works on both contentious and non-contentious agricultural planning matters. He handles cases across the Agriculture sector, including those regarding agricultural regulations, nuisance, wildlife incidents, farm business diversification, and all aspects of planning and environmental law.

  • advising on planning strategy to maximise quantities of enabling development in relation to the restoration of historic agricultural site which included a Grade II*-listed house, and two Grade II agricultural buildings
  • advising landowners on rights of way including responding to applications for Definitive Map Modification Orders
  • advising on planning strategy to maximise the development value of an old SSSI-designated quarry
  • supporting business owner under investigation by a local authority Environmental Health department
  • advising clients on Certificate of Lawfulness applications, planning appeals, enforcement issues, and permitted development rights
  • advising on proposed applications, application of conditions, and interpretation of policy
  • negotiating and drafting Section 106 Agreements, Deeds of Variation and Unilateral Undertakings
