Harvey is an experienced lawyer in our Planning and Environment team, heading up the firm’s thriving Natural Capital practice.

With a unique blend of legal and business experience, also managing the family farm in Herefordshire, Harvey provides clients with commercially practical advice on the emerging markets for natural capital and supports them in the delivery of innovative and profitable solutions for improving the environment.

Since joining the firm in 2022, he has established himself as a “go to” legal resource for farmers, landowners, agents and consultants across the country on issues relating to nutrient neutrality, biodiversity net gain and emerging voluntary natural capital markets. 

This includes advice on purchasing land, strategic aspects of natural capital markets, negotiating and drafting s106 agreements to secure land as BNG sites, reviewing Habitat Management and Monitoring Plans (and other related reports), and advising on the requirement for any consents/licences/permissions.

In his time with the firm, Harvey has conceived and delivered some of the most significant pioneering natural capital projects in the country, often directing multidisciplinary teams for clients and co-ordinating ecologists, civil engineers, hydrologists and other consultants to develop innovative natural capital projects which optimise the use of clients’ land and natural resources. 

With a practice spanning the firm’s Agriculture and Development of Land specialisms, Harvey works closely with experts from across the firm’s many practice areas, including property, private client, corporate and commercia, to find and deliver the solutions to the environmental challenges businesses may face.

  • Leading on the design and delivery of two nationally significant schemes in Norfolk and Kent to provide a strategic mitigation solution for the highly complex issue of nutrient neutrality which had been stymying development in these regions for over two years, resulting in the unlocking of the delivery of thousands of new homes in the area while ensuring the protection of internationally significant habitats sites.
  • Advising a major agricultural organisation on the delivery of environmental mitigation by farmers for HS2.
  • Advising a large group of farmers on a project funded by the Natural Environment Investment Readiness Fund in relation to the creation of one of the largest UK woodland creation schemes under the Woodland Carbon Code, accessing new emerging markets for carbon sequestration and the options for legal structures and commercial arrangements.
  • Advising a farming family on changes to its horticulture business to generate a multimillion-pound nutrient mitigation scheme for the Hampshire Avon while retaining the ability to produce crops using next generation environmentally sustainable growing methods; also co-ordinating matters with the Thrings’ Private Client team on the succession and tax aspects of the project.
  • Advising a natural capital business on the delivery of one of the largest strategic biodiversity gain sites in the country, located in the South Downs, including negotiating and drafting the s106 agreement.
  • Advising a landowner in Hampshire on the formulation and framework for a multimillion-pound natural capital project which stacks nutrient mitigation and biodiversity gains on the same land and assisting with the delivery of the project to the market.
  • Acting for a landowner in relation to a conditional contract for the sale of land to a large developer for the purpose of developing a large wetland to provide nutrient mitigation for developers with additional provisions relating to securing the land as a biodiversity gain site and associated commercial arrangements.
  • Advising a developer in relation to a large residential site and the use of a wetland to mitigate nutrient impacts (under the Habitats Regulations) and associated negotiation and drafting of the s106 agreement with the local planning authority.
  • Advising a large farming organisation as a supply aggregator on the establishment and delivery of a private environmental marketplace connecting growers with corporate funders to incentivise certain agricultural practices for greenhouse gas reductions and other environmental benefits.
  • Advising a Community Interest Company on the establishment of a land-based scheme to provide biodiversity and community benefits funded by a B Corp certified business to help meets its ESG requirements.
